2. What personal data do we process, and why?
We process personal data primarily to provide high-quality dental care and dental hygiene. We process the following categories of data:
- Identification and contact details: first and last name, personal identification number, date of birth, permanent address, phone number and email address.
- Health data (a special category of personal data): information about your health condition, medical history, examinations and procedures performed, laboratory results and X-rays, and health insurance information.
- Data from a future call-back assistance service: we are preparing a service that will let you sign up for call-back assistance directly through the website. Once it launches, we will process the data you provide when signing up (typically name, phone number, and possibly email) so we can call you back. We will add a specific description to this section once the service is live.
- Data from routine communication: information you share with us when arranging an appointment by phone or email.
3. Legal basis for processing
We do not process your personal data arbitrarily, but always on a clear legal basis:
- Compliance with a legal obligation: as a healthcare provider, we are strictly required by Act No. 372/2011 Sb., on Health Services, to keep medical records.
- Provision of healthcare and prevention: processing health data is necessary for preventive and clinical medicine, establishing a medical diagnosis, and providing care (Art. 9(2)(h) GDPR).
- Performance of a contract: arranging appointments and providing care under a healthcare agreement.
- Legitimate interest: protecting the clinic's legal claims (e.g. resolving potential disputes) and ensuring the security of our systems.
4. Who do we share your data with?
We keep patient data strictly confidential and are fully bound by medical confidentiality. Only the following recipients may access your data, to the extent necessary:
- Relevant health insurance providers (for billing and reimbursement purposes).
- Other healthcare providers (e.g. when referring you to a specialised facility or a dental laboratory), where necessary for your treatment.
- Authorised state institutions where required by law (e.g. ÚZIS, the Czech health information institute).
- Our vetted external processors (e.g. providers of electronic health record software, web hosting providers, or our accountant), who are contractually bound to maintain the same level of data protection.
5. How long do we keep your data?
We retain your personal data only for as long as required by law. For medical records, we follow the retention periods set out in Decree No. 98/2012 Sb., on health documentation. Most medical records must, by law, be kept for 10 years from the patient's last examination or change of treating physician. Personal data from the website and general communication that does not become part of your medical record is kept only for as long as necessary to handle your request.
6. Cookies
The website uses two types of cookies, which you decide on during your first visit:
- Essential (technical): these ensure the basic operation of the website, for example remembering your cookie consent choice. They do not store any personally identifiable information and do not require your consent.
- Optional: these allow a map (Google Maps) to be shown on the Contact page. They only load after you give consent; without consent, nothing is loaded.
Once given, your browser remembers your consent choice. If you want to change it, simply clear this website's data (cookies/ local storage) in your browser, the consent banner will appear again on your next visit.
7. What rights do you have regarding your personal data?
Under the GDPR, you have a number of rights. Please note that, due to the specific nature of healthcare (a legal obligation to keep records), some of these rights may be limited:
- Right of access: you have the right to obtain confirmation of whether we process your data, and to request a copy or extract of your medical record.
- Right to rectification: if your personal data (e.g. address or phone number) is inaccurate, you have the right to request its correction.
- Right to erasure ("right to be forgotten"): this can only be exercised for data for which the legal reason for retention has ceased to apply. Medical records cannot be deleted until the statutory retention period has expired.
- Right to restriction of processing: you may request that processing be restricted in certain specific situations.
- Right to object: to processing based on our legitimate interest.
- Right to lodge a complaint: if you believe we are not handling your data in accordance with the law, you have the right to file a complaint with the Czech Office for Personal Data Protection (www.uoou.cz).
